Q: If the father of my son gets legitimized does this prevent me from moving to another state for job advancement with son
He will be 2 in November and I work for the VA.
A: The court will determine where the child should be regarding custody, visitation, child support, and any other matters, which include where the child will live on a permanent basis. If the court determines that the child cannot be removed from the jurisdiction, they will state that in an Order. If you decide to remove the child from the jurisdiction, there will likely be language in a court Order that states the non-custodial parent must be notified. And that gives the other parent a chance to file for a modification of visitation or a modification of custody and have you served. The court could then decide that you can move, but maybe the child cannot be removed. But attorneys on this board cannot tell you what a judge may or may not do, on a matter that has not occurred yet.
