A: A Colorado criminal defense attorney should advise here, but your question remains open for almost two weeks. I recommend considering a consult with a criminal defense attorney. It's likely that your question was missed because it was overlooked under the "Car Accidents" category. This is a criminal defense matter, although you are correct - it does involve a car accident. If your criminal defense attorney would follow a similar theory to a tort defense (civil side of things), I believe they would raise the issue that being seizure-free for sixth months, you did not have reason to suspect that you would experience a seizure. I believe an attorney would want to know about your medical records here for two reasons - (1) first to show a period of no seizures for sixth months, supporting your position that you were reasonable in not anticipating one, (2) second to support your belief that your accident was seizure-related. This second element would require a recent evaluation and a medical opinion on whether your theory is plausible. Again, my analysis is based on the TORT aspect of matters - I recommend you consider consulting with a CRIMINAL DEFENSE attorney to seek their guidance. It's possible they could analyze things differently, and THEIR analysis and advice is what you should follow. I hope you are okay. Good luck
