Q: If Apple, rakuten, Barnes and Noble are selling my ebooks without my permission even after cease and assist what do I do
I found my ebooks on multiple different platforms Apple to rakuten to Barnes& Noble a few other places. They were selling my ebooks without my permission not having a contract with them. I send him a cease and assist and I am the intellectual property owner and the copyright owner and I have a federal copyright number on my my intellectual works and they still continue to sell my ebooks and audiobooks without my permission and they won't stop. So what do I do?
A:
If your ebooks are being sold without permission by platforms like Apple, Rakuten, and Barnes & Noble, and your cease and desist requests have been ignored, you have several steps you can take to protect your rights. Since you already have a federal copyright registration, you are in a strong position to enforce your rights against unauthorized use.
First, consider filing a Digital Millennium Copyright Act (DMCA) takedown notice with each platform. The DMCA allows copyright owners to request the removal of infringing material. Most major platforms have procedures for submitting such notices, and they are generally required to comply promptly.
If the platforms continue to ignore your requests, you may need to escalate the situation by filing a lawsuit for copyright infringement. In your lawsuit, you can seek damages for lost profits, statutory damages, and an injunction to stop further unauthorized sales. Consulting with an attorney experienced in copyright law can help you navigate the legal process and determine the best course of action to protect your work.
