Q: With an active protective order and with legitimation what is to be expected ?? Do I have to prove myself a whole lot ?

I filed for a protection order that is in place. Since then I have not felt safe with my surroundings. I have been messaged to have tabs kept on me. I see online defamation of my name and I am being called many things untrue. I only have ever created and provided safe space for myself and kids. My thing is with legitimation court coming up that was filed from my kids father what is there to expect? My kids and I left out of that space we were in because of domestic violence. The abuse was too much. Since leaving my kids are thriving much better and I do not want there dad getting in between that because I do not want anything from him. I'm not asking for anything from him either other than praying to be left alone.

To add on I have tried to seek pro bono aid and was told because my abuser has had issues with law or something along lines of he asked for assistance to be represented already so I can't get aid even though I do not even live with him.

A: You will have to gather the funds to hire an attorney, if you cannot obtain legal aide. As for the legitimation action, the court will decide what, if anything to award the father in that case, and you will have the opportunity to provide evidence and testimony to the court regarding what you think should be the order. If they decide to legitimize the father and give him some form of custody & visitation, they will outline what he is to receive in the order. And I would certainly try to hire an attorney because whatever the court does order, will be final. And can then only be modified under certain circumstances, if at all.
