A: The Federal government through the NHTSA mandated that all cars manufactured from 1986 and on to to have the third brake light. Georgia law requires that if a car was manufactured with two brake lights, both must be operational (OCGA 40-6-25(b)) and in general that all brake lights work properly and be in good condition (OCGA 40-6-26).

So, if your car is from 1985 or earlier and manufactured without the third brake light, it is not required to have one.
