Q: I bought a vehicle from an individual and they will not file for me a title what do I do
When I bought the vehicle they said they had filed for a lost title and it was supposed to be in soon I talk to them again they said title was lost and that they can't file for a title because they don't have the bill of sale
A:
If the seller is unable to provide a title or file for a replacement, you may have a few options to resolve the situation. First, ask the seller for a written and signed bill of sale or other proof of purchase that includes details about the transaction, like the vehicle’s VIN number, the purchase price, and both parties’ contact information. This can serve as proof that you own the vehicle.
Next, contact the Arkansas Department of Finance and Administration (DFA) to inquire about the process for obtaining a title yourself. In Arkansas, there are procedures to help buyers who face difficulties with titles, including the possibility of filing for a bonded title if the original cannot be produced. You may need additional documentation, such as a completed Vehicle Identification Number (VIN) verification, to proceed with this.
If the seller continues to be uncooperative, you might need to take legal action or consult with local authorities about how to proceed. It’s important to act quickly to avoid complications with registration or liability related to the vehicle.
