Q: Question as to how to go about registering a vehicle in Georgia to an ax spouse solely?
My wife and I recently divorced and we have a loan on a Hyundai Santa Fe. I am first on the loan and she is a co-borrower. According to the court documents, she has all rights to the vehicle and it’s in her possession and the loan itself is addressed to her address in northern Georgia. She lives in Catoosa County. I live in Wilkinson county. I’m trying to figure out how to register it in Catoosa County where she resides so she can have the vehicle up there. Catoosa County tag Office is trying to say that since I’m first on the loan I have to register it which means I’d also have to have insurance on it in my name down in Wilkinson County in middle Georgia. But that makes no sense because my ex has the vehicle and, it has legally been given to her in the separation agreements. So I’m just trying to figure out how to go about registering the vehicle in Catoosa County where my ex resides so she can have it there and it’s off of my hands except for making the payments on the loan?
A: All of this should have been addressed in your divorce. Either you would have signed a settlement agreement or you should have spoken about this during your trial, where the court should have made a final decision. That final decision would have been included in your final judgment. Anything not addressed during your divorce the parties will have to deal with on their own. Talk to your spouse.
