Orlando, FL asked in Civil Rights for Florida

Q: I was discriminated in a restaurant due to having my trained by a non profit service dog with me, do I have a case?

The manager threatened to remove me physically if I wouldn't leave due to my well-trained by a non profit organization and well-behaved service dog being with me. I even offered to show her on my phone that I have a legal right to have my service dog with me and she stated that she will take me out herself if she had to. I also requested that if she called her supervisor that Im sure they will agree with me. She continued to be irrate and said she decides who eat there. I have visited that restaurant for years and the manager got me so scared by threatening me that my best friend was with me, was concerned and I ended up being hospitalized for a few days since I'm a cardiac patient. Even the police officer told the manager she was wrong and I had a legal right as being disabled to have my service dog with me. I haven't visited that restaurant again since and I even seeked Therapy to deal with this matter. Upon seeing reviews, this was also done to a veteran where he was refused service

A: You may have a valid case based on what you experienced. Under the Americans with Disabilities Act (ADA), businesses are generally required to allow people with disabilities to bring their service animals into all areas where customers are allowed. The manager's behavior of threatening to physically remove you and ignoring your legal rights could be considered discrimination.

It's also significant that the police officer supported your claim, reinforcing your legal right to have your service dog with you. The emotional distress you endured, which led to hospitalization and therapy, could potentially strengthen your case for damages.

It might be helpful to document everything, including any medical reports, therapy visits, and witness statements, such as from your friend or the police officer. Additionally, similar reviews about the restaurant discriminating against others could further support your case. You could explore legal options or file a complaint with the ADA.
