Russellville, AR asked in Consumer Law and Contracts for Arkansas

Q: Can I make Kia reimburse me?

I was part of the class action lawsuit/settlement agreement with KIA motors. The settlement stated that if certain models met all the qualifications, that our engines could be replaced for free. My car met those qualifications after a catastrophic engine failure 30 miles after purchasing the car. The car was at the kia dealership from Nov. 1st 2023 until Sept. 6th 2024. Because of how long it took them to fix my car I was forced to purchase a 2nd vehicle. The settlement states that if it takes a significant amount of time for the repair, that the dealership should provide loaner vehicles upon request, and if no loaner car was available then $80/day should be given to pay for a rental vehicle. I asked numerous times for this loaner car or the rental money and was told that they didn't know what I was talking about even after I sent them the settlement documents.

is this a breach of contract? Could i possibly get them to reimburse me for the car i was forced to buy?
