Q: OP making it hard for me to work evenings at my job. OP started calling between 20-33 times a month for 2 years now.
The parenting plan states, When child is in the physical custody of one parent, the other parent will have the right to contact the child by telephone. Other parent is saying I need to be available every time he calls the kids. In addition I don’t like the fact of buying a phone for the child because OP has constantly questioned the child about me. Asking the child where I work and have recently told the child that I’m committing a crime for having a disabled tag. OP even asked the child to gather info about my car tag and to go back to tell them about it. Will I be held in contempt because I’m working? I can’t depend on child support because OP is behind 23k
A: You need to consult with an attorney who can review your parenting plan and give you advice. The answer to your question depends on what is written in the parenting plan.
A: Telephone visitation is not ordered so one party can harass another. The calls need to be reasonable while the child is in your care, custody & control. However, if your schedule prevents you from allowing the other parent to talk to the child, and you refuse to get the child their own phone or let the other parent get the child a phone, you may run the risk of being in contempt, if they cannot contact the child because you're at work. So I would try and ensure that I am not violating the parenting plan and make the child available reasonably so, for visitation by phone.
