New York, NY asked in Family Law, Child Custody, Civil Rights and Domestic Violence for West Virginia

Q: Hello, Thank you in advance for helping. CPS took my kids because my husband was emotionally and physically abusing us.

He has since relinquished his rights to the kids.. They are forcing me to do the same for "failure to protect". I want to know, if I appeal the descion, will those allegations from the CPS come about in court? I was under serious duress and in and out of the hospital and therapy during the whole two months my kids have been gone. I believe they are forcing me to just give up my kids and they are threatening jail time and saying i have warrants when i do NOT. they have turned my family against me and i have no support. the court lawyer doesn't answer and he is saying its best to relinquish my rights because the case worker is aggressive in court. If i appeal the relinquishment and i can prove i took my classes, went to therapy and have housing for my kids, will they give me my kids back?
