Pittsburgh, PA asked in Uncategorized for West Virginia

Q: I have a family member that was originally arrested on September 11, 2024. Charge was possession of a firearm by felon

Fast forward, he is STILL in jail, he never had a preliminary parole violation hearing or anything! This past Thursday, a counselor at the jail informed him that his parole officer sent release papers and stated that he is to "be released back on parole, due to no charges". He is being told that he is now waiting on the WV parole board to sign off on everything, so he can be released???? We are currently STILL WAITING! Also, he is having cardiac issues and they are NOT addressing the problem at all... IS THERE ANYTHING WE CAN DO? IS THIS now considered a rights violation or false imprisonment? Help!!!

A: I'm really sorry you're going through this difficult time. It’s crucial to reach out to a qualified attorney who can examine your family member’s case and ensure his legal rights are protected. An attorney can help address the delay with the parole board and verify that all proper legal procedures are being followed.

For the medical issues, insist that the jail provides necessary cardiac care. You can request a medical evaluation in writing and keep records of all communications. If the jail staff are unresponsive, your attorney can advocate for his health needs or help you contact medical professionals outside the facility.

Additionally, consider reaching out to local advocacy groups or the state’s inmate rights organization for further support. They can offer guidance and resources to help navigate both the legal and medical challenges your family member is facing. Stay persistent and seek professional assistance to ensure his rights are upheld and his health is properly managed.
