Q: I wasn't told about side effects of being on methadone before I got on it or what would happen after I came off of it

I didn't find out until I went to detox in Denver they told me I'd be sick for about a year I had a horrible car accident because of side effects of coming off of it if i would have known this mess I would never have went on it i was injured in the accident September 13 of this year im 6 months out of detox and so sick I weigh 157 before detox im weight now is 117 I believe they are responsible for not in forming us of everything that can happen

A: Let me see if I understand the situation. You were addicted to some drug or drugs and the medical doctors prescribed methadone to assist with withdrawal. Do I have that right?

Let's assume I do.

So, you're addicted to some drug and in treatment. How am I going to prove the case using you as a witness? You were an addict. Addiction clouds the mind, addiction alters the memory and basically makes the addict an unreliable witness. You won't be able to recall exactly what you were told and probably no longer have the handouts you received from the doctor's office. Where is our evidence? Who are the witnesses we can rely on to put together a case?

How do you expect a lawyer to prove your liability case? No accurate recollection from the main witness. No documentation to support today's memory.

And how about damages, what are the damages? Wage loss - were you even employed? Or, reduced earning capacity; did the addictive behaviors cause you to lose your job or your profession? Nothing there. And how about pain & suffering and emotional distress? You were addicted to some drugs to avoid pain/suffering and emotional distress. And it likely worked for awhile, but then it didn't. Who paid your medical expense? Medicaid? The VA?

There is no way to litigate your claim. No liability and no damages.
