Q: Is Non-Disparagement Clause in my Severance Package Legal
My employer has this clause in my Severance Package after terminating my employment to due to findings on an audit of my work. They refuse to show me these findings. My severance pay is my CTO time I have accrued over the 33 years I have worked there as they have that "if you are fired you do not get your CTO pay". I feel they know they are wrongfully terminating me. All of my reviews over the years have been nothing but excellent, most recent being June 2024.
"Employee understands and agrees that she will not make, or cause to be made, any false, disparaging or derogatory statements (whether oral, written, electronic or in any other form) to anyone regarding employer or any of its directors, officers employees, agents, or representatives."
