Q: Is it blackmail if I threaten to turn my former employer in to the DOL for wage and hour violations?
I was terminated for my job for theft after 9 yrs, and my employer and I agreed upon a payment arrangement. If i don't make a payment of 200 weekly they are going to prosecute me. This week I was not able to make payment because I still have not been able to find a job, but they are not willing to work with me. I have documentation and other evidence that would find them in violation of FLSA laws as well as minor labor laws. Is it blackmail if I tell them to work with me on my payments and if they are not willing to I will give the DOL information that will launch a full investigation into the company?
