Q: Can I get a case dropped/dismissed if I wasn't read my Miranda rights at time of arrest?

A: The police only have to read you the Miranda warning if they interrogate you in police custody and then want to use that testimony as evidence against you in a trial of your case. Otherwise, the info they received from you would not be admissible. Just the simple fact that they didn't read you the Miranda warning when they arrested you is not sufficient by itself to warrant dismissal of your case.

A: Ms. Rogers is entirely correct. Unfortunately TV and Movies have been getting the Miranda warnings wrong since the day after the Supreme Court issued it's ruling requiring them.
