Q: Will a mother go to jail if a breast fed baby tests positive for cocaine

The mother used it a few times and hasnt used it in 2 months and a test was done recently and showed super high levels in the babies system and the father (who has 0 percent custody) is using it as blackmail to keep the child and telling her she cant do certain things or he will turn it in to the county, seems like blackmail and parental alienation, the father has also done it in the past and unsure if he is still currently doing it and also lives in income based housing and pays 100/month but works for cash, she is afraid that if she takes it to court she will lose the child and go to jail, any help or advice is much appreciated.
