Fort Wayne, IN asked in Landlord - Tenant for Indiana

Q: How do I formally evict family members without a written lease but by word of mouth agreements?

My stepdaughter came to stay with me when her father had a near death experience. She had been living with her mother at the time. Soon after, her fiancé , with whom she had been broken up arrived for support. They have both been living here mostly rent free for one year and ten months. We have had several discussions about move out dates of which they have not met. Their claim is that they have been turned down by every place they have tried due to no rental history and because he is a convicted felon. It will be 8 years in March for expungement but could be expunged early if he will write to District Attorney for early expungement. I have been the one to contact the prosecuting attorneys office to get this information, but Matthew has not followed through with sending the letter. He has a good job but it is seasonal and he has not even started looking for an interim job. Sara is disabled and will begin receiving survival benefits since her father’s death on August 3.
