El Dorado, KS asked in Construction Law for Kansas

Q: Can I refile a mechanics lien after filing a lien extension first, and how should I handle the incorrect filing

I live in Sedgwick County, Kansas. I mistakenly filed a lien extension before properly filing my mechanics lien. The county clerk informed me that my mechanics lien would not be recorded due to this mistake and did not accept payment for the filing. I did go ahead and record the mechanics lien with the clerk. I did not serve the property owner with the lien. But did serve by certified and regular mail the initial filing of the lien extension. I’m unsure if this has affected my ability to file a new mechanics lien. Can I refile, and if so, what steps do I need to take to ensure it’s filed correctly? Including handling the wrongly filed lien. I've included the lien extension and mechanics lien mentioned. Thank you for your assistance!
