Q: Do I have the right to deny him custody for Thanksgiving and the weekend to allow the children to stay local?
My ex-husband moved out of state in August, and we currently have 50/50 custody. He now visits every other weekend or so for day visits, and the children return to my house to stay. I have them full-time and have applied for primary custody. A master agreed the custody document should be adjusted as he no longer resides in Pennsylvania and has no set return date. We have a court hearing scheduled for December.
According to the current custody order, my ex is entitled to have the kids from Thanksgiving at 3 PM until Friday, plus the weekend following. However, he is planning to take the kids to New York, where he currently lives, but the children want to stay local and spend Thanksgiving with their family (on his side, whom I will take them to see). The kids have told him that they do not want to go but he told them that they are going with him up to NY (4 hour trip).
