St Louis, MO asked in Medical Malpractice for Missouri

Q: Can I sue for a partial knee replacement gone bad?

Had partial knee replacement last fall, but started having pain this year. Had an x ray done and the doctor said it was loose. Knee sometimes locks up and feels like a stabbing pain. Would this be a class action or an individual lawsuit?

A: A Missouri attorney could advise best, but your question remains open for three weeks. However, no attorney could answer your question based on the limited details. I'm sorry for your painful ordeal. Although you suffered a bad outcome, the issue will be whether or not there was a breach of a duty of medical care which was causally related to your injury... in other words, negligence, error, or related acts/omissions that caused your situation. Surgeries do go wrong without anyone being to blame. To advise meaningfully, a law firm would probably request input from an orthopedic surgeon. Your question about class action - did this involve a medical device that was the subject of complications in other patients? That would be a determining element there. You could reach out to Missouri attorneys to try to set up a free initial consult. Good luck
