Q: What are the steps to file a motion for Interim Attorney Fees to be paid for by husband in New Mexico?
I left my husband almost 20 yrs ago for sexual abuse and we were never legally separated but he has now filed for divorce. I need to know what the steps are and what forms are required to file a motion for Interim Attorney Fees (Motion for Temporary Relief) to be paid so I can hire an attorney to represent me in the divorce. What documentation is needed to be filed with the forms so that the courts will award them to me? I also would like to know how I am I suppose to list all the marital property and its value for division of assets when he changed the locks and refused me access to anything including all my personal items 20 yrs ago so there are no bank statements or invoices or receipts as proof of value? In addition I do not have access to see what all he still has nor do I know what has been given away or sold and how much he received from the sell so what will the courts do in this case to keep it fair? He kept everything I got nothing but the bag of clothes I took when I left.
