Q: Does Personal Injury Lawyer get a % of settlement if it’s not above the original insurance company offer?
Minor son in car accident. Another Minor was driver of car. His insurance company offered 25k pain and suffering. Talk to Lawyer and he thinks we can get more. If I hire him and we still only get 25k, does he take a full share of the settlement even though I could have gotten that on my own? Thanks.
A: Yes, he would be entitled to his fee, but since your child is a minor, Fee in NJ would only be 25%

A: It could be best to pose the question to the law firm and check the terms of their retainer, to see if they reflect any concessions/reductions for results already achieved on your own. Different firms might handle such situations differently, to the extent permitted by court rules. Good luck
