Rochester, NY asked in Estate Planning for New York

Q: My wife and I want protection from a future challenge of Undue Influence and Lack of Mental Competency.

What type of attorney do we need to help my wife and I establish a defense against a future challenge of Undue Influence and Lack of Mental Competency to our Will, and or to either of us personally? We will also want a new Will and Powers of Attorney drawn up, and to possibly discuss some other thing's as they may pertain to our situation. We each are not guilty of Undue Influence nor have a Lack of Mental Competency and want to establish a defense now so we can live the rest of our lives in peace and without fear of any and all unjust attacks against our Will, our estate or either of us personally, having any chance of succeeding, and especially so at a time when we are at our weakest state.

Thank you so much.

A: Hello there! You would want an attorney who handles Estate Planning, or an attorney who does Trusts & Estates. The attorney could draft and supervise the execution of Wills, POAs, and other estate planning documents. During the Will signing ceremony, the attorney can ask the right questions to help protect against claims of lack of capacity, undue influence, or improper execution.

Feel free to ask a follow-up question or reach out with more questions. Best regards!
