Atlanta, GA asked in Criminal Law for Georgia

Q: Pending warrant from another county. Never got picked up from jail. Released after 7 days. What to do now? No charges!

Hello I brought weed into a prison while visiting my friend got caught in a county 3+ hours away from home. Was out in jail next county over never was booked, charged, or finger printed. Was released after 72 hours with no bail and no judge or court visit. Sent home with no papers of future court visit or knowledge. 10 months later I'm being pulled over in the county I live in for pending warrant system said waiting to be picked up from another agency. No official charges. Stayed in the jail for a week and was released again no one picked me up. Now what should I do? Who can I talk to so I can get charges dropped and what steps do I need to take to get this off my record. If convicted this will be a first time offense. I am in school full time and I don't want this to affect my future with getting my school licenses. And how can I get mugshots removed from google and mugshot sites?

A: Just because a county elected not to pick you up on a warrant, does not mean the warrant goes away. If you are stopped by the police and they find a warrant from a different agency, typically they will hold you and inform the issuing agency. It is then up to the agency that has the warrant to decide if they will come get you at that time. If you are released, the warrant will still be there. You need to speak with a defense attorney ASAP.

In terms of getting a mugshot removed, this depends on the site. Typically, once the charges are dismissed or my client is acquitted at trial, we send the final disposition to the website that is publishing the mugshot with a request to remove it from their site. It normally takes a few days but they will take it down.
