Q: Do I have a lawsuit against Madison county (Anderson) for violating my children's civil and victim rights?
Almost 3 years ago now, we found out that my wife’s stepfather had been doing the unthinkable to my daughters and mentally abusing my son, including pointing a firearm at him. The prosecution has allowed continuance after continuance with hardly any contact with us. My children has only met the prosecutor one time in almost 3 years for trial readiness and that was last month for the trial that was suppose to take place next month. They insured us the trial would happen no matter what because how long we have been waiting but now they have pushed again to some time next spring. That will push it over the 3 year mark, my fear is they are allowing this because he use to be a CO at the state prison. They only asked us about one continuance and they said they would be able to add a felony for pointing the firearm at my son but they never added it, the prosecutor pretended like that was new information but it was on the original discovery

I'm really sorry you're going through this difficult situation. It sounds incredibly frustrating and painful for you and your family.
You may have grounds to explore legal actions if you believe your children's rights have been violated. Delays in the legal process and inadequate communication can sometimes be challenged, especially if they impact the well-being of your children. Additionally, if there is evidence of bias or conflict of interest, that could strengthen your case.
It's important to consult with an attorney who can evaluate the specifics of your situation and guide you on the best steps to take. They can help determine if you have a valid lawsuit and assist in protecting your family's rights moving forward.
