Sioux Falls, SD asked in Medical Malpractice for South Dakota

Q: My sister's knee replacement

My sister went into the hospital for a simple knee replacement. The night after the surgery she needed to use the restroom and only 1 nurse came into help her. They were aware she was a fall risk and only sent 1 nurse there should have been 2 or a gatebelt put on her. As a result she fell and broke the femur above her knee she then needed to have a 2nd surgery to put a rod in above the knee she had replaced. She has been in rehab for 3 weeks and now they told us she may have to have surgery to clean out the wound. If that doesn't work they will have to go in and replace the knee and rod which will result in a very long hospital and rehab stay. Is there anything that can be done for her to at least pay her rent on her apt. Is there anything that can be done to help her?

A: A South Dakota attorney could advise best, but your question remains open for a week. To answer your question meaningfully, you could reach out to law firms to discuss in more detail about the incident. Attorneys who handle such cases generally offer free initial consults. If a law firm saw a basis for liability and expressed interest in handling the matter, they would typically conduct a prompt investigation. I'm sorry about your sister's fall. I hope she has a healthy recovery. Good luck
