Queens, NY asked in Family Law and Child Custody for West Virginia

Q: I want to move out of wv and keep primary custody of my daughter. My ex disagrees, but only spends 2 days with her.

I want to move out of wv state to ky (72 miles from my current location) with my daughter, but her other parent doesn't agree. In our arrangement (which is oral and not through the courts) he only sees her 2 days a week. I want to keep this schedule and bring her on weekends to see her father, and still be able to move and have her with me primarily. We want to move in with my boyfriend of 3 years so that I can have a stable home for her, because I live paycheck to paycheck in my current living situation. Will a court approve the move based on this information or would they be more likely to give custody to my ex?
