Q: I want to know the chances I have of getting my charges dismissed.
I am an RN and i got pulled over after work due to “expired tags”. I was on a dark road during being pulled over so I waited while driving slowly to the nearest gas station. I’ve never been pulled over before so i was scared and didn’t know to put on my hazards. my tags were never expired, the tag office never updated my renewal in their system and sent me a letter stating it was their fault. I was charged with expired tags, attempt to elude while driving and obstructing/hindering law enforcement due to not wanting to get out of my car when told to. This is my first offense and i’m disappointed in how i reacted to the situation out of fear.

There is a lot that can be done in a situation like this. First, if the tag office has conceded that your registration was valid then the prosecutor should work with us to drop that charge. Next, I have dealt with several cases that involved my client delaying there stop so as to find a safe and secure location to stop there vehicle for the duration of the traffic stop. In all of these cases the prosecutor agreed to drop the fleeing charge. This will be very fact specific and the first thing we would do is collect the dashcam/bodycam footage to get a better sense of what happened. However, what you describe sounds entirely reasonable.
I know it must be tremendously frustrating to have been put in this situation, however, there is a lot that can be done to get this resolved.
