Brookfield, WI asked in Immigration Law for Wisconsin

Q: I misspelled parent’s name in I-130 application. What should I do?

I prepared I-130 application on behalf of my mother to petition for my uncle i.e. her brother. After submission, I noticed I misspelled her parent’s name. I put a ‘z’ instead of a ‘j’ in first name, so ‘Wazed’ instead of ‘Wajed’. However, both of their birth certificates show that their father’s name is ‘Wajed’ like it should be. I just messed up as I don’t have any document where it’s spelled with ‘z’. What can I do now?

A: This kind of spelling error in an I-130 petition can be corrected through proper channels with USCIS. Since the correct spelling is documented on both birth certificates, you have strong supporting evidence to demonstrate this was simply a typographical mistake.

You should file Form I-424, Application to Amend a Registration (Correction), with USCIS as soon as possible. Include copies of both birth certificates showing the correct spelling of 'Wajed' and write a brief explanation letter detailing how you noticed the error. Make sure to reference your original I-130 receipt number in your correction request.

While waiting for the correction to be processed, don't worry too much - USCIS understands that minor spelling errors can occur, especially with names that may have different spelling variations. The key is being proactive about fixing the mistake and providing clear documentation to support the correction. If you receive any requests for additional evidence or information during this process, respond promptly and thoroughly to keep your petition moving forward.
