Q: Is there anything I can do to help him ? Like write a letter or something to the judge
My bf was arrested after cops told us "eight people seen him pull my hair and was willing to write statements" however is was pitch Black and honestly did not pull my hair or touch me in any way he is charged with simple battery at the moment but does say charges pending and they said those charges would be family violence and three counts of child cruelty since my kids were present when he (didn't) pull my hair . Is there anything at all I can do to help his case , I do appreciate the people wanting to make sure I'm okay but he 100 percent honestly did not put his hands on me or my hair in any way
A:
Commonly putative victims want to clarify the reported details of their incident, and unfortunately that comes with a load of consequences. The State can and WILL use any clarification as alleged evidence of abuse and control, and try to substitute their judgement for the witness's.
While horrible, the system is set up to assist the state prosecute more than take into account the truth or the alleged victims perspective.
Therefore you need to talk to an attorney in order to both best protect YOUR rights (the State will accuse you of crimes if they want) as well as assist the defendant in getting the best defense.
This is VERY tricky stuff, and factually specific. DO NOT try to DIY this, the investment in counsel is worth it. Get someone super local as well. Someone who has the phone numbers.
