Tempe, AZ asked in Car Accidents for New Mexico

Q: I was in an accident three years ago and the settlement is ending but I’ll still owe money to the hospital. Should I sue

The lawyers will be walking away with the same amount I’ll be after all their fees where I’ll be walking away with 7 when I pay the bill. Is it worth pursuing a lawsuit against the other driver or would I be drowning in lawyer fees? Would I have the potential to get more money? The injury ended my guiding career and I can no longer to physical jobs which is the kind of work I love; I want justice but would that be worth it?

A: A New Mexico attorney could advise best, but your question remains open for a week. My quick guess is that you would not be able to sue if you signed a standard release when you received your settlement money. The formats used by the insurance industry usually encompass all forms of money damages - in other words, "Here's your money - we're done here."

But that's only a quick guess. Don't go by my guess. Instead, sit down with your attorney and ask them about the terms under which your case was settled. Were hospital bills/liens part of the settlement? That and other details would be relevant in determining your rights here. I'm sorry for your difficult position - I hope there is some means available to you in meeting your medical bills. Good luck
