Q: Rape kit shows no DNA inside of person claiming to be raped. Can they still try to prosecute for rape?
The supposed victim stated he forced himself inside and relieved himself as well. No DNA was found inside victim and he was arrested in July without any evidence. Arrested for someone saying it happened. They just now sent evidence gathered in July to lab for testing 7 months later. The law states they are supposed to have evidence submitted within 60 days of arrest. The accusations were made the same day he was took in for questioning and later arrested. There was no investigation was done to seek out witnesses or the other people that lived in the house weren't questioned to see how the people were acting if if they suspect it happened. He's now been indicated on just hearsay. Not to mention the victim has accused others as well in the past and it was all lies.
A: Defendant needs to hire a competent attorney to defend him at trial, now. He might get convicted the way he is going, as he apparently did not have a preliminary hearing.
