Lovettsville, VA asked in Health Care Law, Civil Rights and Family Law for Tennessee

Q: Seeking a fertility healthcare lawyer in Tennessee to recover missing embryos and protect reproductive rights.

I'm seeking a lawyer who practices fertility healthcare law and respects our religious beliefs that God wants us to recover our missing embryos and that I should bear our own children. We've spent $50,000 with a previous lawyer but have not retrieved our missing embryos and other genetic materials (zygotes, fertilized eggs, unfertilized gametes, and ovarian tissue). We were deceived into signing consents that were conditional and not official contracts, and we wish to revoke these due to a lack of full understanding. We are unwilling to accept a monetary settlement as it may be perceived as payment for our children. Any settlement with the fertility clinic should focus on the return of our genetic materials. We demand fertility healthcare without discrimination, as we firmly believe it is our reproductive and human right to become pregnant and carry our own children with our own gametes. We need a lawyer who can protect us against discrimination and offer services at a rate we can afford. Although geographically flexible, we are primarily looking for representation near our home, with a focus on Virginia, Tennessee, and North Carolina. Our prayers have led us to consider Tennessee strongly, but we also have a longstanding appointment with Duke University that requires legal advocacy.

A: Good Morning:

I have reviewed your dilemma that you posted on Justia.

I view your causes of action as being an unconscionable contract, and a civil conspiracy as the primary matter to be litigated and the return of the embryos and rescission of the contract .

You did not mention what jurisdiction the events occurred in. I am in Court this morning but I will be in my office at 11 CST.
