Q: How to get spouse to pay car insurance during divorce in CO?

I am currently going through a divorce and need my spouse to pay her portion of our car insurance. We are separated, and both names are on the insurance policy. We previously discussed splitting expenses, and she paid her share for a few months. However, she now ignores my requests for her portion. The only legal measure currently in place is the standard temporary injunction. What steps can I take to ensure she pays her share?

Assuming that standard practice has been followed and that everyone is properly joined to the case and no other pertinent orders have been entered by the Court, you are keen to focus on the Automatic Temporary Injunction (commonly referred to as the “ATI”). Generally, as it relates to the payment of expenses during the pendency of the case, the best way to conceptualize the ATI is that the parties need to maintain the status quo. Largely, that means that the parties need to continue what they have been doing.

There are a number of way to address alleged ATI violations. A very practical step is to let the other party know you believe they are in violation of the ATI and put them on notice that you intend to take further legal action if compliance is not met.

I would also caution that you should consult with a competent and licensed attorney to help you appropriately strategize and ensure that any measure taken to possibly enforce the ATI does not conflict with your overall legal position or jeopardize your interest in the outcome of the case.
