Oak Lawn, IL asked in Workers' Compensation for Illinois

Q: How can I address a closed workers' comp claim due to treatment delays?

In March 2024, I filed a report with workers' compensation after a workplace injury and received a case number. Initially, I managed the injury with at-home care, but in May, I went to urgent care due to worsening pain. As a nurse, I attempted to self-manage afterward, facing delays due to personal challenges, including my son's health issues and job changes. Recently, I contacted the workers' compensation office and was informed my case was closed due to treatment delays, despite not being notified of the closure. No prior communication was received from workers' compensation regarding case deadlines or requirements. I now have significant hip problems. What steps can I take to address this situation and potentially reopen my workers' comp claim or seek further assistance?

A: I answered this question yesterday when you posted it on Avvo. You now add the detail of "changing jobs." That complicates things. You MUST consult an experienced WC attorney ASAP to have any hope of resurrecting your claim. The reason for delay is legally insignificant.
