Q: What can I do if a family member with temporary custody won't let me see my kids in Georgia?

I've given temporary custody of my children to a family member due to my arrest, through a court order and my voluntary agreement. However, now they refuse to allow me any contact with my children due to their own malicious intent. They have threatened me with a TPO, though a previous TPO was thrown out for being based on falsehoods. No specific legal steps have been taken by me yet, as I was unaware of my options and felt threatened. The children still reside with this family member, and I'm unsure of how to proceed. What rights do I have in this situation?

A: You need a family lawyer STAT. Someone needs to get involved immediately before this rolls out of control. Find someone LOCAL who will know all the players and get them involved ASAP.

A: If the person who has your children has temporary guardianship then you can file to terminate that guardianship. If they have custody you can file for a modification of custody. But you can always take that person back to court to get custody of your children back. Or if you just want visitation you can file for visitation. I would speak directly with an attorney to provide more information and they can give you a more definitive answer regarding your options. But you don't ever have to leave your children with someone who is not allowing you any contact.
