Atlanta, GA asked in Uncategorized for Georgia

Q: I want to know if the document im being asked to sign obligates me to pay anything and if I can get out of it

I authorized as my contractor to:Inspect and document the condition of my roof with the insurance adjuster.Communicate directly with my insurance and mortgage companies if necessary, to expedite payment. Obtain an “agreed scope” approval from my insurance company.. Proceed with the repairs or replacements within 30 days of approval and funding. Upon approval of the claim, I will execute a contract with Fraser Roofing, LLC for the repairs and/or replacements specified by my insurance company for a price equal to, but not exceeding, the full amount of my insurance proceeds. The only exception would be upgrades, building code compliance or warranty required items that may not be covered by the insurance company. I understand that there are no charges for these services other than the awarding of the contract, and I hereby award the contract, contingent upon approval of my insurance company. Contingent means that if there is no

approval from the insurance company, there is no contract.

A: A Georgia attorney could advise best, but your question remains open for two weeks. It's likely that your question remained open because it is difficult for any attorney to offer a definitive answer that you can feel certain with. Any attorney will want to review your contract and its terms for cancellation or termination ("getting out of it" that you mention). The contract looks like it could be contingent upon insurance carrier approval, and as such, MIGHT involve work on a third-party assignment basis (POSSIBLY where your carrier pays the contractor directly). But no one can be certain without seeing the entire contract. It could be worth considering reviewing the contract thoroughly with a Georgia attorney, depending on the importance and amount of this contract. Good luck
