Q: How can I avoid jail for a first violation of felony probation?
I am facing a violation of felony probation (VOP) due to being arrested in a different county for driving on a suspended license while going to work. I've been on probation for almost 3 years with this being my first violation. Despite getting released the same day and planning to have my license reinstated before the court date, my probation officer has issued a violation and wants me to turn myself in. If incarcerated for more than a few days, I risk losing my job, my home, and falling behind on child support, which could lead to the suspension of my license again. I have two upcoming court dates within two weeks, and there has been no discussion with my probation officer about alternatives due to my fear of incarceration. What can I do to remain out of jail in this situation?
