Q: Can CPS take our newborn due to medication issues during pregnancy despite compliance with parenting classes and counseling?

I am concerned about Child Protective Services (CPS) possibly taking our newborn child away. My baby mom didn't take her psychiatric medications during her pregnancy due to advice from her doctor, who provided documentation stating that the meds posed a risk to the fetus. We have been diligently participating in parenting classes and mental health counseling, with proof of compliance. Although we have a prior history with CPS involving the removal of our older daughter, we are working hard to meet all their requirements. Her mental health conditions do not impair her parenting, and we have professional support for this belief. Additionally, we have a court appearance related to this matter in 5 hours. Given these circumstances, can CPS still take action against us regarding our newborn?
