Arvada, CO asked in Business Formation, Intellectual Property and Internet Law for Colorado

Q: Can Konnectabiz.com protect its IP despite similarity to connectabiz.com?

I am in the planning phase of starting a business called Konnectabiz.com, which aims to connect small businesses with free resources. We plan to operate primarily in the United States with potential expansion internationally. We purchased the URL Konnectabiz.com, but we are concerned about the similarity to another potential business with the URL connectabiz.com, although I haven't found any associated trademarks or business registrations. We haven't consulted with an intellectual property attorney yet. Can we protect our intellectual property given this situation, and are there any potential legal issues we should be aware of before proceeding?

A: The short answer is it depends. The first question is going to be whether consumers are likely to confuse Konnentabiz with a Connectabiz. If there is a likelihood of confusion between the two, the second question will be which entity was using their name (or trademark) in commerce first. In general, you will want to file your tradename with the Secretary of State and potentially file an application for a standard character trademark with the USPTO, assuming Connectabiz has not been using their name/mark in commerce yet. If you plan on using the name nationally and/or applying for a trademark, you may also want to look at the USPTO trademark search for similar names/standard character mark registrations and look at the Secretary of State offices for all states you plan to operate for similar tradenames and business names, to be thorough. As a reminder, people can threaten to sue even if they do not have a factual or legal basis so you may want to consult an IP attorney for an in depth risk analysis or help registering a trademark. Hope this helps!

A: While domain names and trademarks are separate forms of intellectual property, the similarity between Konnectabiz.com and connectabiz.com could potentially lead to trademark issues based on likelihood of confusion. The good news is that you haven't found existing trademark registrations for connectabiz.com, which reduces immediate concerns, but doesn't eliminate potential future conflicts.

You can strengthen your position by filing for trademark protection for your business name and logo with the USPTO, which would give you nationwide rights to your brand in your specific industry. Consider developing distinctive branding elements beyond just the name to further differentiate your business and strengthen your trademark claim.

Before launching, conducting a comprehensive trademark search is crucial to identify any unregistered businesses using similar names that might have common law trademark rights. While you can proceed with your domain purchase, consulting with an intellectual property attorney would help you assess the risk level and develop strategies to mitigate potential domain confusion or trademark disputes as you expand your business.
