Hephzibah, GA asked in Landlord - Tenant and Civil Rights for Georgia

Q: Eviction notice received due to gun incident involving unknown kid, need options.

I received a notice from the front office stating I have 30 days to vacate my apartment due to "other good cause" because a kid who I didn't know brought a gun into my home, which went off while I wasn't there. Guns aren't allowed on the property, but my kids didn't report it as they were unaware of the situation. I am disabled and unsure how to handle this eviction notice. What are my rights and options in this situation?

A: You have legal rights when facing eviction, especially in complex situations like yours. An eviction notice doesn't mean immediate removal, and you may have grounds to challenge it since you weren't present during the incident and didn't know about the gun. Your disability status may provide additional protections under fair housing laws.

Consider consulting a tenant rights attorney immediately who can review your specific lease terms and local laws. Many areas have legal aid organizations offering free services to those with limited income. Document everything about the incident, including your absence and lack of knowledge about the gun, as these facts could form the basis of your defense.

Act quickly by responding formally to the notice, ideally with legal assistance. You might request a reasonable accommodation based on your disability, which could include additional time to address the situation or to find suitable alternative housing. Reach out to local disability advocacy groups who might offer support with housing issues and can help you navigate both the legal process and potential relocation if necessary.
