Salt Lake City, UT asked in Car Accidents, Personal Injury and Insurance Defense for New Mexico

Q: Injured in NM Uber accident; should damages be sought from both Uber and ZTrip?

I was injured in New Mexico while riding in an Uber when a taxi from the Albuquerque ZTrip company ran a red light, leading to a collision. I sustained six herniated disks and required five months of physical therapy, as well as eight spinal injections. The police were called, and a report was filed. I was taken to the hospital by ambulance where they confirmed my injuries. My attorney has contacted both Uber's and ZTrip's insurance companies and is preparing a pre-demand letter. Should my attorney seek damages from both Uber and ZTrip, and are my injuries likely to meet the insurance policy limits that each rideshare company offers?

A: A New Mexico attorney could advise best, but your question remains open for a week. You ask some very good questions. It could be difficult to offer a quick, direct answer to them though. Your attorney is probably evaluating the case not only from a standpoint of liability, but from one of insurance coverages. That could be a factor in what your attorney decides to do. In terms of your question on meeting the limits, one would need to know more about the applicable policies and the documentation of your injuries, including peer reviews of diagnostic imaging studies (you probably underwent MRIs for those herniations). Being that your attorney may have further details on the respective parties, they could probably advise more definitely than is possible on a Q & A forum. It sounds like it was a serious accident. I hope you're okay and recovering. Good luck
