Q: How long will I have to wait for my case to reach trial? My lawyer says he doesn't know for sure.

A: This depends on which County your case is pending in, and how congested the trial calendar is in that County. Traditionally, there has always been a very long wait for trial in the Bronx and Brooklyn, since thees have always been more plaintiff oriented counties, and plaintiffs' attorneys will choose to start their cases there if one of the parties resides in those counties. in Westchester County, where many of my cases are pending, the wait for trial can be several months to well over a year once the case is on the trial calendar, and this is true in many counties in the suburbs such as Rockland, Orange and Dutchess. recent budget cuts which have reduced Court personnel and required shorter working hours will undoubtedly worsen this problem.
