Q: In a personal injury case, who pays the expenses in the case, the lawyer or the client?

A: Generally speaking, the attorney will pay the expenses of the case up front, and then at the end of the case, the expenses are deducted from the settlement or verdict proceeds. In the case of my own clients, I take my fee off of the net proceeds (after deducting for expenses, so that I am paying part of the expenses as well). Thus, at the end of the case, the expenses are paid by both the client (66% of the expenses) and my firm (33% of the expenses). Many lawyers take their fee off the gross proceeds, meaning that they do not share in the expenses with their clients at all.
