Q: Legal for Respondent who is Atty in protective injunction after final ruling to subpoena 3rd partys & no hearing?
He filed a motion to vacate protective injunction, sent same to Petitioner. Petitioner has not received confirmation from Court about Respondent motion no notice of hearing. Petitioner's request to Quash subpoenas was Granted. Respondent is Atty contacting business partners, non-witnesses, non-experts, and school records. Violation of Injunction? Abuse of Process? Conduct unbecoming a member of the Bar?
A: This question was posted over 2 years ago. I hope things have been resolved by now. Yes, it is legal to subpoena 3rd parties.
