Q: If payments are made on note, does statute of limitations run from due date in note or date of last payment?

A: Statute of limitations begins to run as soon as a right to sue can be maintained. Generally, if you are making payments then stop it will run from the date of your last payment.

However, the statute is tricky - there are all kinds of other issues. I have not seen the note and I don't know if it is governed by GA law or some other state's law. Also, the statute (if this is in GA) is 6 years in GA for most things not 4.
