Q: My ex found out I had an affair while married...I got afraid of him and got a protet order..can he subpoena other man?
He got really mad..he and I were talking of getting back together when he found out, He called names, cussed, intimidated me. When we go to court for this order, he says he is going to subpoena the other man. Can he do this? He thinks the affair gave him right to act like he did and lose his temper.
A: He can subpoena anyone he wants. It's up to you or the person who receives the subpoena to file to quash the subpoena or to object at trial about the testimony as irrelevant to the issues. However, relevancy will be determined by the judge.
