Q: Realtor presented a home for sale without a clear title, Am I entitled to a refund for the appraisal fee?

2 months ago, we entered into a contract for purchase with a broker. House was not able to close 2+ weeks ago because the title had a small debt ( we offered to negotiate that debt to clear the title) . Broker/ realtor has now taken the home off the market to foreclose (again?) Home was presented and listed as bank owned. We sold our home in the meantime and will be homeless in 19 days. Worth mentioning... our contract agreed price is a little less than the home could sell for, and the home appraised $4,000. higher than the contract. Home also just got the power turned on and someone is testing the Air Conditioning unit. We had an "AS IS" contract with no inspection for the last 2 months. Homes sell very fast in this area and this home could sell for about $15,000 higher than the contract was written.
