Tallahassee, FL asked in Family Law for Florida

Q: Would I be able to name guardians for my child in the event of my death or would I need sole custody?

Father abandoned my son at 5 months old, cut off all communication and provides no support for our son. I have medical issues and asked my oldest son's father and step-mother if they would take my youngest son if something happened to me so that my children would not be seperated. I also feel it is in the best interest of my son to be with someone he is familiar with as he does not remember his father and I want to make sure the father can not just pop up out of the blue to claim the child for monetary gain.

A: Yes you need to prepare a pre-need guardian designation.

Use of a lawyer is recommended.
